We may make changes to these Terms from time to time. If you continue to use the App and/or Site after these changes have been made, we will assume that you have accepted them. If you do not agree to any of these Terms, please do not click “ACCEPT” and do not use the App and/or Site. At the moment, SuperDesk makes certain versions of the App and/or Site available to you free of cost, but we may choose to charge and change the pricing at any time in the future.

Information We Collect:

We collect and store information that you voluntarily provide to us as well as data related to your Site visit and use of the Services. We may request that you provide personally identifiable information, including your name, title, company name, email address, phone number and other information from which your identity is or may be discernible. The information we collect may be stored on our servers, and on the servers of third-party service providers.

In addition, we automatically collect certain aggregate information and analytical data related to your Site visit usage and use of the Services (see “Use of Cookies” below). Aggregate information is non-personally identifiable or anonymous information about you and may include the date and time of your visit, the IP address of your computer or mobile device, your computer or mobile device browser information, the Internet address that you visited prior to and after reaching the Site or Service, the name of the domain and host you used to access the Internet, the type of mobile device you use, your mobile device’s unique device ID and the features of our Site and Service which you accessed. This data is not associated with your personally identifiable information.

Personal data provided by the user will be collected automatically by SuperDesk in case of usage of our product or services. Unless specified otherwise, the data requested by SuperDesk is mandatory to fill by the user, and failing to provide this will make it impossible for the user to use our SuperDesk services. In fields where we have already mentioned that it’s not mandatory to fill in the details, users can choose not to insert any detail as they are only optional. The users are responsible for any third-party Personal Data collected/shared/published by SuperDesk or by the third-party service providers used by SuperDesk services.

Limited License

SuperDesk grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to access the Site and/or use the App for internal business purposes at the time of these Terms. The App is made accessible over the Internet and no source code or executables are provided. SuperDesk reserves the right to modify the App and/or Site at any time.

In exchange for your payment of any applicable license fee for the Software, SuperDesk grants you the right to use and run the SOFTWARE on a single computer, without the right to license the SOFTWARE to others.

How We Use Information:

We use collected information to make available and to improve our high standard of reliable solutions. We use such information to

  • Respond to inquiries and monitor such responses;
  • Provide information about and market our products or solutions and third-party services;
  • Analyze visitors’ access to and use of the Site and the Services;
  • Resolve website problems to improve and manage the Site and the Services.

We will not sell or rent personally identifiable information to third parties who are not affiliates of our Company, unless it is necessary to provide a requested service or to provide information about available products or solutions, including third party services and products.

We may disclose non-personal information that does not permit direct association with any specific individual, or aggregate information about our users, to third parties such as advertisers, national industry organizations, and prospective affiliates.

We may also cooperate with legal investigations, and share your information with our parent, subsidiaries, and joint ventures, as well as agents and legal representatives, to coordinate services, enforce our terms and conditions, and promote trust and safety. In the event of a merger or acquisition, the successor company would have access to the information maintained by us and would be subject to the same/updated privacy policy.

Method of processing the data:

Required security measures are taken to protect the data and prevent unauthorized access/ disclosure/ modification of the data. We stick to the purpose and process the data using computers or IT tools and we might make the data accessible to the administration and operations team in SuperDesk. We might, when needed, make it accessible to external parties (Third-party technical /cloud service providers, hosting providers, and communication/email agencies) if necessary. The user might request to share the details of these third-parties at any time.

Legal processing of data

We, SuperDesk owners, may process your personal data in case of,

  • Users have agreed to allow the Owner to process their Personal Data for one or more specified purposes. In certain 
jurisdictions, the Owner may be allowed to process Personal Data, even if the User does not give their consent (known 
as “opt-out”), unless the processing is subject to European data protection law.
  • Data must be provided to fulfill any contractual obligations and/or pre-contractual requirements between the User and 
the Owner, or to comply with any legal obligations to which the Owner is subject.
  • Processing may also be necessary for tasks in the public interest or in the exercise of official authority vested in the Owner, 
or to pursue the legitimate interests of the Owner or a third party.

The Owner will willingly explain the exact legal justification for processing Personal Data, such as if it is legally mandated, part of a contract, or required for entering into a contract.

Place

Data processing may take place at the Owner’s operating offices, as well as any other locations where parties involved in the processing are located. This may include transferring the User’s Data to countries outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN.

Users are entitled to know about the legal basis of the transfer, as well as any security measures taken by the Owner to protect their Data.

Data Retention and Retention Time:

Personal Data will only be processed and stored for as long as necessary to fulfill the purpose for which it was collected. Depending on the purpose of the Personal Data collected, the retention period may vary. If the Personal Data has been collected in order to fulfill a contract between the Owner and the User, it will be retained until the contract has been fully performed. Personal Data collected to pursue the Owner’s legitimate interests will be retained until these interests have been met.

If the User has provided consent for the processing of their Personal Data, it will be retained until consent is withdrawn. Additionally, the Owner may be required to retain Personal Data for a longer period if necessary for the performance of a legal obligation or upon the order of an authority.

After the expiration of the retention period, the Personal Data will be deleted and the User’s rights to access, erasure, rectification and data portability cannot be enforced.

The purpose of processing:

The data the User provides is collected in order to allow the Owner to provide its services and for the following specific purposes: analytics, hosting and backend infrastructure, handling payments, managing support and contact requests, infrastructure monitoring, contacting the User and registration and authentication. Additional information can be found in the corresponding sections of this document regarding the specific Personal Data used for each purpose.

Payments:

SuperDesk uses payment processing services to securely process payments made by credit card, bank transfer, or other methods. Only the necessary information is shared with the financial institutions handling the transaction. Additionally, SuperDesk may send out automatic messages, such as invoices and payment notifications, to customers or users.

Hosting and Backend Infrastructure:

SuperDesk is hosted on services that store data and files, allowing distribution and providing pre-built infrastructure for its features and components. These services are usually spread out across multiple geographical locations and determining the exact location where the personal data are stored could be difficult.

Various type of personal data is collected by this hosting and backend service provider cloud platform Azure

Infrastructure Monitoring:

SuperDesk uses this service to monitor its components’ usage and behavior, so as to enhance their performance, reliability, maintenance, and troubleshooting. The type of Personal Data that gets processed is determined by the particular features and implementation of the service, which filters SuperDesk’s activities.

Mailing List and Newsletters:

By registering for SuperDesk’s mailing list or newsletter, your email address will be added to our contact list, allowing us to send you emails with commercial or promotional information about our services. Your email address may also be added to this list as a result of signing up to SuperDesk after making a purchase. We collect personal data such as your email address, first name, and last name.

Registration and Authentication:

By authenticating with SuperDesk, Users allow the company to identify them and grant them access to their respective services. If a third-party provider is utilized for registration and authentication, SuperDesk will have the right to access certain data stored by the said provider for those purposes.

SuperDesk will collect the organization name, email address, first name, and last name directly in the registration form.

Furthermore, if registered and authenticated using the Google platform it will collect various types of data as described in their respective privacy policy

The Rights of the user:

Users may exercise certain rights with regards to the Data being processed by the Owner. In particular, they have the right to:

  • Withdraw their consent at any time
  • Object to the processing of their Data, access their Data, verify and seek rectification of their Data, restrict the processing 
of their Data
  • Have their Personal Data deleted or otherwise removed
  • Lodge a complaint with the relevant data protection authority.

Users can contact the Owner to exercise their rights, free of charge. All requests will be addressed promptly, within one month.

Cookie Policy:

Cookies are small text files stored on your computer by a web browser and are used to access certain features of a website or service. We may use cookies to help collect and track usage of the Site and Services, and to make navigation easier. Most web browsers offer the option to accept, decline or delete cookies. If any changes affect processing activities based on the User’s consent, the Owner will obtain new consent if necessary.

Choice and Opt-out Option:

You have the option to opt-out of having your personal information used for certain purposes. If you would like to stop receiving marketing material from us, click the unsubscribe link in the communication. If you no longer wish to receive our newsletter and promotional communications, you can opt-out by following the instructions in each communication.

If you are located in the European Economic Area (EEA) or elsewhere outside of the United States, any information you provide to us in connection with your use of our Site or Services will be transferred to the United States as the company’s site and services are operated in the United States. Age Limitation:

This website and its services are not designed for people under 18 years old. If you discover that your child has provided us with personal information without your consent, please contact us at support@superdesk.ai. We do not knowingly collect, solicit or accept services from people under the age of 18. If we learn that we have received information from someone under 18, we will take steps to delete that data and remove such information from our site.
